I’m truly grateful and happy to share that my subsequent entrant 500 visa has been granted today! My case was quite challenging — I had a very short marriage duration (only 3 months), and I had not even completed showing my graduation at the time of application. Because of these reasons, many agencies were not willing to take my case. But cia lawyers believed in my case and handled everything with great professionalism, honesty, and care. Their guidance, proper documentation, and constant support made this success possible. I highly recommend their service to anyone with a complex or genuine case. If your case is strong and truthful, the right legal support can truly make a difference. Thank you again for your dedication and hard work! I am greatful.

I’m incredibly grateful to CIA Lawyers for helping me secure my Australian visa, especially at a time when the approval rate was extremely low. Even when the chances seemed slim, they stayed confident, guided me honestly, and handled my application with absolute precision. Their experience, attention to detail, and clear communication truly made the difference. I wouldn’t have gotten this result without them. Highly recommended.

Our Protection Visa Services

At CIA Lawyers, we handle all three types of onshore protection visas available in Australia. Whether you are applying for the first time or dealing with a refusal, our Sydney immigration lawyers are here to help.

Permanent Protection Visa (Subclass 866)

The Permanent Protection Visa (Subclass 866) is the most common protection visa for people who arrived in Australia on a valid visa. If you are granted this visa, you can live and work in Australia permanently. You also get access to Medicare, study rights, and a pathway to Australian citizenship.

This is a one-chance visa. If your application is refused and all appeal options are closed, you generally cannot apply again. That is why getting the right legal help from the start matters so much.

Our lawyers build your Subclass 866 application from the ground up. We help you write a clear and credible claims statement, gather supporting evidence, and make sure every part of your application meets the legal test set by the Migration Act 1958.

Temporary Protection Visa (TPV, Subclass 785)

The Temporary Protection Visa (Subclass 785) is for people who arrived in Australia without a valid visa and need protection. It gives you the right to live and work in Australia for three years. After that, you need to reapply.

This visa does not lead to permanent residency on its own. It also comes with limits on work and study rights depending on your situation.

If you hold a TPV and your circumstances have changed, or if your reapplication has been refused, we can help you understand your options. Our team reviews your full case and advises you on the most realistic path forward.

Safe Haven Enterprise Visa (SHEV, Subclass 790)

The Safe Haven Enterprise Visa (Subclass 790) is also for people who arrived without a valid visa. It is similar to the TPV but is linked to living and working in a regional area of Australia. It is valid for five years.

If you work or study in an approved regional area for at least 42 months during your SHEV period, you may become eligible to apply for certain other visas. This can be a pathway out of temporary status for some applicants.

SHEV applications and the rules around regional work requirements are complex. Our Sydney protection visa lawyers explain exactly what you need to do and help you track your obligations throughout the visa period.

Requirements for a Protection Visa Application

Understanding what you need before you apply can save you from a costly mistake. Below are the key requirements the Department of Home Affairs looks at when assessing a protection visa application in Sydney.

You Must Be in Australia

You can only apply for a Subclass 866 Protection Visa while you are physically in Australia. You cannot lodge this application from overseas.

You Must Have Arrived on a Valid Visa

For the permanent protection visa, you must have entered Australia legally. This means you arrived on a valid visa, such as a tourist visa, student visa, or work visa, and were cleared by Australian immigration at the airport.

If you arrived without a valid visa, you may be eligible for a Temporary Protection Visa (Subclass 785) or a Safe Haven Enterprise Visa (Subclass 790) instead.

You Must Show a Genuine Fear of Harm

This is the heart of your application. You need to show that you have a well-founded fear of persecution or serious harm if you return to your home country. Your fear must be connected to at least one of the following grounds:

Race or ethnicity

Religion

Nationality

Political opinion

Membership of a particular social group

If your situation does not fit neatly into one of these categories, you may still qualify under complementary protection. This applies where you face a real risk of torture, the death penalty, or other serious harm that falls outside the strict refugee definition.

Your Application Must Not Be Barred

Australian law prevents some people from applying for a protection visa even if they have a genuine fear of harm. You cannot apply if:

You have previously applied for and been refused a protection visa in Australia (the one-chance rule under Section 48A)

You hold a Subclass 785 or Subclass 790 visa

Your current visa has a No Further Stay condition (Condition 8503, 8534, or 8535) and no waiver has been granted

You Must Meet Health and Character Requirements

You need to pass a health examination conducted by an approved panel doctor. You also need to provide police clearance certificates from every country where you have lived for 12 months or more in the past 10 years.

Prior criminal history does not automatically disqualify you, but it must be handled carefully. Our lawyers advise you on exactly how to address character issues in your application.

Your Current Visa Must Still Be Valid at Time of Lodgement

You should lodge your application before your current visa expires. If your visa expires before you apply, you may become unlawful and your options become much more limited. If you are approaching your visa expiry date, contact us immediately.

Your Claims Must Be Supported by Evidence

The Department does not just take your word for it. Your application must be supported by strong, credible evidence. This includes your personal statement, country condition reports, witness statements, medical or psychological reports, and any other documents that support your claims.

At CIA Lawyers, we help you identify exactly what evidence you need and make sure it is presented clearly and in the right format. A well-documented application gives you the best possible chance of approval.

Why Sydney Clients Trust CIA Lawyers for Protection Visa Applications

There are many firms offering protection visa assistance across Sydney. Here is what makes CIA Lawyers different.

This distinction is critical in protection visa matters. Only qualified lawyers can represent you at the Administrative Review Tribunal and in federal court. CIA Lawyers is a law firm operating under full legal professional obligations.

Your case is handled by experienced legal professionals from the initial consultation through to the final decision. We do not pass your file to a junior assistant after your first meeting.

If your case is strong, we will tell you. If it faces real difficulties, we will also tell you that clearly. Honest advice protects you from spending time and money on an application that has limited prospects.

We understand that protection visa clients are often processing serious personal trauma. Every conversation is conducted with care and strict confidentiality.

All costs are discussed openly before you engage us. There are no unexpected charges mid-application.

Our team is based in Sydney, New South Wales. We assist clients across Australia and internationally via in-person, phone, and video consultations.

We assess your eligibility and give you a realistic, honest picture of your options before you commit to anything.

How CIA Lawyers Handle Your Case

Applying for a protection visa without qualified legal representation is a significant risk. The Department of Home Affairs now processes applications faster than ever, which means poorly prepared applications are refused just as quickly. A mistake early in the process can affect your entire immigration record.

Here is exactly how we work with you from day one.

Step 1: Confidential Eligibility Assessment

Every protection visa claim is unique. We begin with a thorough, private consultation where we listen to your full circumstances. We assess your country of origin, the nature of the harm you face, your entry history, and any prior visa decisions. You receive an honest legal opinion before anything is lodged with the Department.

Step 2: Preparing Your Protection Claims Statement

This is the most important part of the entire application. Your statement of claims must clearly and credibly explain the persecution or harm you fear. It must address the legal criteria under the Migration Act, draw on relevant country of origin information, and be supported by independent evidence wherever possible.

We work closely with you to compile and structure supporting documentation, which may include:

Personal declarations and witness statements

Country condition reports and human rights organisation evidence

Medical or psychological reports where relevant

Police reports, court documents, or news coverage connected to your case

Step 3: Lodgement and Bridging Visa Management

Once your application is lodged with the Department of Home Affairs, you are typically granted a Bridging Visa that allows you to remain in Australia lawfully while your case is being assessed. We manage the entire lodgement and ensure your bridging visa conditions are correctly understood and maintained throughout.

Step 4: Responding to Departmental Requests and Interview Preparation

The Department may request further information or arrange a protection visa interview. This is a critical moment. We prepare you thoroughly for any interview scenario and handle all correspondence on your behalf. An unprepared answer at this stage is one of the most common causes of application failure.

Step 5: The Decision and Next Steps

If your visa is granted, we guide you on your ongoing obligations as a protection visa holder. If it is refused, we advise you immediately on appeal options at the Administrative Review Tribunal (ART) and, where relevant, judicial review in the Federal Circuit and Family Court.

What Sets us Apart

Strong Local Presence in Sydney

Based in Sydney, CIA Lawyers provides immigration legal services across Sydney CBD, Parramatta and Western Sydney. Our team regularly works within Australia’s legal and migration framework, with experience appearing before the Administrative Appeals Tribunal (AAT), the Federal Circuit and Family Court of Australia (FCFCOA), the Federal Court and other relevant jurisdictions. Being locally based means we understand how migration matters are handled within New South Wales and at the federal level. We are familiar with court procedures, tribunal expectations and Department of Home Affairs processes, allowing us to prepare cases thoroughly and represent clients with confidence.

Proven Track Record of Success

Strong preparation leads to strong outcomes. Our firm has successfully handled a wide range of visa applications, AAT appeals and judicial review matters. Each case is prepared thoroughly to maximise approval prospects and reduce unnecessary delays.

We Solve Complex Immigration Issues

Visa refusals, cancellations and character concerns require careful legal strategy. We analyse the reasons for refusal, identify the best pathway forward and represent you confidently in appeals and court proceedings when required.

Common Protection Visa Problems We Solve for Sydney Clients

These are situations we see regularly. If any of these applies to you, contact us before taking any further steps.

Your Application Was Refused and You Do Not Know Why

Refusals often occur because critical evidence was missing or the submissions did not clearly address the legal test. We review refused applications to identify whether there are proper grounds for a tribunal appeal and what additional evidence is needed.

Credibility Issues Were Raised Against You

The Department may find your claims not credible if your account was inconsistent across different documents, if there was a significant delay before you lodged your application, or if supporting evidence was thin. We address credibility findings with targeted submissions and carefully gathered corroborating evidence.

You Travelled to Your Home Country After Lodging

If you travel to the country you are seeking protection from, your application may be refused even if your family lives there. This is a serious situation requiring immediate legal advice.

Character Issues Are Part of Your History

Prior criminal history can complicate a protection visa application but does not automatically result in refusal. These matters require careful legal management from the outset, not after a decision has already been made.

You Are in Australia Without a Current Valid Visa

People in this situation face significant complexity. We assess your specific entry and visa history and advise honestly on whether any protection pathway remains available and what the risks are.

Frequently Asked Questions (FAQ)

Yes, in many cases. A Bridging Visa is usually granted after lodgement, and individuals who arrived on a tourist visa may be eligible if they entered lawfully on a valid visa and were immigration cleared on arrival. Your eligibility ultimately depends on the protection claims you make, not the specific visa type you arrived on.

The refugee criteria require proof of a well-founded fear of persecution based on a specific Convention ground such as race, religion, or political opinion. Complementary protection applies where you face a real risk of serious harm, such as torture or the death penalty, that does not fit squarely within the refugee definition. Both pathways lead to the same Subclass 866 permanent visa.

Asylum seekers who have arrived in Australia legally and subsequently apply for protection may receive a Bridging Visa upon lodging a protection visa application, enabling the applicant to remain lawfully in Australia while the application is being reviewed. Bridging visas generally include work rights, though conditions vary. We advise you on the specific conditions that apply to you.

You have 21 days from the refusal decision to apply for merits review at the Administrative Review Tribunal. If the ART also refuses, options include judicial review in the Federal Circuit and Family Court and requests for Ministerial intervention. Information about the refusal will always remain on your immigration record and may make it harder for you and your family to obtain visas in the future.

Family members who are in Australia and form part of your family unit at the time of lodgement can generally be included. Family members outside Australia must apply separately. We advise on the best approach for your family's specific situation.

Operation ABAXIAL was introduced in February 2024 and is a key initiative to stop applicants from misusing the Protection Visa program. It is designed to quickly refuse non-genuine claims and process genuine ones faster. If you have a genuine, well-documented protection claim and proper legal representation, Operation ABAXIAL works in your favour. It makes the quality of your application and the strength of your legal advice more important than ever.
