I’m truly grateful and happy to share that my subsequent entrant 500 visa has been granted today! My case was quite challenging — I had a very short marriage duration (only 3 months), and I had not even completed showing my graduation at the time of application. Because of these reasons, many agencies were not willing to take my case. But cia lawyers believed in my case and handled everything with great professionalism, honesty, and care. Their guidance, proper documentation, and constant support made this success possible. I highly recommend their service to anyone with a complex or genuine case. If your case is strong and truthful, the right legal support can truly make a difference. Thank you again for your dedication and hard work! I am greatful.

I’m incredibly grateful to CIA Lawyers for helping me secure my Australian visa, especially at a time when the approval rate was extremely low. Even when the chances seemed slim, they stayed confident, guided me honestly, and handled my application with absolute precision. Their experience, attention to detail, and clear communication truly made the difference. I wouldn’t have gotten this result without them. Highly recommended.

CIA Lawyers: Qualified Immigration Lawyers You Can Trust in Sydney

CIA Lawyers is a Sydney-based legal firm with dedicated expertise in Australian immigration law. Our team consists of qualified lawyers, not just registered migration agents, which means we can represent clients at the Administrative Review Tribunal (ART) and in Federal Court proceedings if a refusal needs to be challenged.

We understand that parent visa applications carry enormous emotional weight. Families often wait years for an outcome, and any misstep in the process creates delays that cannot easily be undone. That is why our approach is built on thorough preparation, honest assessment, and clear communication at every stage.

Our clients across Sydney, New South Wales, and Australia trust us because we tell them what they need to hear, not just what they want to hear, and we back that up with the legal knowledge to move their case forward.

Our Parent Visa Services

At CIA Lawyers, we handle all parent visa types available in Australia. Whether your parents are overseas or already in Australia, we find the right pathway and manage the entire process for you.

Sponsored Temporary Parent Visa (Subclass 870)

The Subclass 870 is the fastest way to get your parents to Australia. It allows stays of 3 or 5 years at a time, up to a maximum of 10 years.

This visa does not require the Balance of Family Test or an Assurance of Support. This makes it a strong option for families who cannot pass the family balance test or need their parents here quickly.

The sponsoring child must earn at least AUD $83,454 per year and be approved by the Department before the parent applies. This visa does not lead to permanent residency. If permanent residence is the goal, we will map out the best combined pathway for your family.

Parent Visa (Subclass 103 and Subclass 804)

These are the non-contributory parent visas and the most affordable permanent options.

Subclass 103 is for parents applying from outside Australia. The base fee is around AUD $5,280, but the processing queue currently sits at 30 or more years. Many families lodge this as a long-term backup while pursuing a faster pathway at the same time.

Subclass 804 is for parents who are already in Australia and have reached the Age Pension age (currently 67). They can stay on a Bridging Visa while the application is processed.

Both visas require passing the Balance of Family Test. Our lawyers assess this before any application is lodged.

Contributory Parent Visa (Subclass 143, 173, 864, and 884)

These are the most commonly used permanent parent visa pathways because they process much faster than the non-contributory options. The trade-off is cost.

Subclass 143 grants permanent residency directly. As of early 2026, the queue sits at around 12 to 15 years, with total fees reaching approximately AUD $48,000 to $50,000 per parent.

Subclass 173 is a two-year temporary visa that leads to the permanent Subclass 143. It lets families spread the cost across two stages while the parent lives in Australia during the wait.

Subclass 864 is the contributory option for parents who are already in Australia and of pension age. It offers faster processing than the non-contributory Subclass 804.

Subclass 884 is the two-year temporary bridge to the permanent Subclass 864, following the same staged approach as the 173/143 pathway.

Requirements for a Parent Visa Application

Understanding what you need before you apply saves time and prevents costly mistakes. Here are the key requirements the Department of Home Affairs looks at.

The Sponsor Must Be Eligible

The sponsoring child must be an Australian citizen, permanent resident, or eligible New Zealand citizen, settled in Australia for at least two years, and at least 18 years old. For the Subclass 870, a minimum taxable income of AUD $83,454 also applies.

The Balance of Family Test

At least half of your parents' children must live permanently in Australia, or more must live in Australia than in any other single country. Children on student or work visas do not count. The Department treats temporary visa holders as overseas residents. This test cannot be waived under any circumstances. The only parent visa that skips this test is the Subclass 870.

Assurance of Support

All permanent parent visas require an Assurance of Support (AoS). This is a financial bond paid to the Commonwealth Bank:

AUD $10,000 for one parent

AUD $14,000 for two parents

The bond is held for 10 years and is refundable afterwards. If the sponsor's income does not meet the threshold alone, a joint assurer can be added. We advise on this from the start.

Health and Character Requirements

All parents must pass a medical examination by an approved panel doctor and provide police clearances from every country they have lived in for 12 months or more over the past 10 years. Pre-existing medical conditions or a prior criminal record do not automatically cause a refusal, but they need careful legal handling before lodgement.

Correct Lodgement Method

Unlike most visa applications, parent visa forms must be submitted by post to the correct Department of Home Affairs office. Sending to the wrong address can make the application invalid. The visa fee is non-refundable in that situation. We manage the full lodgement process to make sure this does not happen.

Why Choose Us

This distinction matters when applications are refused or conditions become complex. We can represent clients in legal proceedings that registered migration agents cannot.

We assess your actual situation and give you a clear picture of costs, timelines, and realistic outcomes before you commit to anything.

We manage every part of the process: sponsorship, nomination, visa application, Assurance of Support, and post-grant obligations.

Prior visa refusals, health concerns, character issues, and balance of family test challenges are not unusual for our team. We have handled them all.

Every cost is discussed clearly before work begins. There are no hidden charges.

We offer a no-cost first consultation so you understand your options before making any financial commitment.

Our team is based in Sydney, New South Wales, and assists clients across Australia and internationally via phone and video.

How CIA Lawyers Handle Your Case

Step 1: Strategy and Eligibility Assessment

Every family situation is different. We start by reviewing the parent's circumstances, the sponsor's status, and the family's goals. We assess which subclass is genuinely appropriate, whether the balance of family test can be satisfied, and what the realistic timeline and cost looks like across each pathway. No assumptions, no generic advice.

Step 2: Sponsorship Preparation

On the permanent pathways, the sponsoring child must be an Australian citizen, permanent resident, or eligible New Zealand citizen who has been settled in Australia for at least two years. For the Subclass 870, a four-year residency requirement applies. We prepare the sponsorship application and ensure all obligations are properly documented before lodgement.

Step 3: Application Lodgement

We prepare a complete, decision-ready application. This includes gathering identity documents, birth certificates, evidence of the sponsor's Australian status, health examination referrals, police clearances from every country lived in for 12 months or more over the past decade, and any additional evidence specific to the subclass. Applications lodged with incomplete or inconsistent documentation can be queued for review or refused. We get this right the first time.

Step 4: Assurance of Support

Permanent parent visa applications require an Assurance of Support (AoS), which is a legal financial undertaking provided to the Australian government. The AoS bond for Subclass 143 or 864 is AUD $10,000 for one parent or $14,000 for two, held for ten years. We explain the full obligations of the AoS and assist the assurer in completing the process accurately.

Step 5: Ongoing Case Management and Post-Grant Advice

Once lodged, we monitor the application, respond to any requests from the Department of Home Affairs, and keep the family informed at each stage. After grant, we advise on travel conditions, Medicare enrolment, and future pathways to Australian citizenship for permanent visa holders.

What Sets us Apart

Strong Local Presence in Sydney

Based in Sydney, CIA Lawyers provides immigration legal services across Sydney CBD, Parramatta and Western Sydney. Our team regularly works within Australia’s legal and migration framework, with experience appearing before the Administrative Appeals Tribunal (AAT), the Federal Circuit and Family Court of Australia (FCFCOA), the Federal Court and other relevant jurisdictions. Being locally based means we understand how migration matters are handled within New South Wales and at the federal level. We are familiar with court procedures, tribunal expectations and Department of Home Affairs processes, allowing us to prepare cases thoroughly and represent clients with confidence.

Proven Track Record of Success

Strong preparation leads to strong outcomes. Our firm has successfully handled a wide range of visa applications, AAT appeals and judicial review matters. Each case is prepared thoroughly to maximise approval prospects and reduce unnecessary delays.

We Solve Complex Immigration Issues

Visa refusals, cancellations and character concerns require careful legal strategy. We analyse the reasons for refusal, identify the best pathway forward and represent you confidently in appeals and court proceedings when required.

Common Challenges in Parent Visa Applications and How We Resolve Them

Failing the Balance of Family Test

The balance of family test requires that at least half of an applicant's children live permanently in Australia, or that more children live in Australia than in any other single country. For families spread across multiple countries, this test can be difficult to satisfy. We assess whether the test is met, advise on how to document it correctly, and identify whether the Subclass 870 pathway is a more suitable alternative.

Health and Character Issues

All parent visa applicants must meet health and character requirements set by the Department. A past medical condition or a criminal record, even a minor one, does not automatically disqualify an application, but it requires careful legal handling. As qualified immigration lawyers, we can provide proper legal advice on these issues before lodgement.

Incomplete or Incorrect Documentation

Parent visa applications are document-heavy. Missing a police certificate, submitting an outdated health examination, or providing inconsistent evidence of the sponsor's settlement can all cause delays or refusals. We manage the full documentation process and conduct a thorough review before anything is submitted.

Visa Refusal and Review

If a parent visa application is refused, applicants may have the right to seek a review at the Administrative Review Tribunal. This is time-critical. As qualified lawyers, CIA Lawyers can represent your family at the ART and, where necessary, in Federal Court. We review the refusal decision carefully, identify the grounds for challenge, and prepare the strongest possible case for review.

Subclass 870 Sponsorship Rejection

The Subclass 870 sponsorship application is lodged by the child in Australia and must be approved before the parent can apply for the visa. A rejected sponsorship prevents the parent from lodging at all. We identify potential risks in the sponsorship application before it is submitted and address them proactively.

FAQ

The Contributory Parent Visa (Subclass 143) is the fastest permanent option currently available. Processing can take six or more years, but that is significantly shorter than the 20-plus-year wait associated with the non-contributory Subclass 103. If your parents need to be in Australia sooner, the Subclass 870 temporary parent visa can be processed within a few months and allows stays of up to five years at a time.

The balance of family test requires that at least half of your parents' children live permanently in Australia, or that more of their children live in Australia than in any other single country. If your parents have children in multiple countries, this test can be complicated to assess. Our immigration lawyers review your family's circumstances in detail during the initial consultation to confirm eligibility before any application is lodged.

It depends on the subclass. The Aged Parent Visa (Subclass 804) and the Contributory Aged Parent Visa (Subclass 864) can be lodged onshore by parents who have reached pension age, and they can remain in Australia on a Bridging Visa while the application is processed. Most other permanent parent visa subclasses require the applicant to be outside Australia when the visa is granted.

A refusal is not necessarily the end of the process. Depending on the grounds of refusal and the visa subclass, there may be a right of review at the Administrative Review Tribunal (ART). Time limits apply, usually 21 days from notification. As qualified immigration lawyers, CIA Lawyers can advise on whether the grounds for refusal can be challenged and represent your family through the review process.
