I’m truly grateful and happy to share that my subsequent entrant 500 visa has been granted today! My case was quite challenging — I had a very short marriage duration (only 3 months), and I had not even completed showing my graduation at the time of application. Because of these reasons, many agencies were not willing to take my case. But cia lawyers believed in my case and handled everything with great professionalism, honesty, and care. Their guidance, proper documentation, and constant support made this success possible. I highly recommend their service to anyone with a complex or genuine case. If your case is strong and truthful, the right legal support can truly make a difference. Thank you again for your dedication and hard work! I am greatful.

I’m incredibly grateful to CIA Lawyers for helping me secure my Australian visa, especially at a time when the approval rate was extremely low. Even when the chances seemed slim, they stayed confident, guided me honestly, and handled my application with absolute precision. Their experience, attention to detail, and clear communication truly made the difference. I wouldn’t have gotten this result without them. Highly recommended.

What Is the Business Innovation and Investment (Permanent) Visa (Subclass 888)?

The subclass 888 visa is a permanent residency visa for people who have already held a subclass 188 provisional visa and met its requirements.

It is the second stage of the Business Innovation and Investment (Provisional) visa (subclass 188). You can apply for it after you have fulfilled the requirements of your provisional visa.

Once granted, you can live and work in Australia permanently. Unlike the provisional subclass 188 visa, subclass 888 holders are not required to make additional investments or maintain specific business operations after the visa is granted.

You also gain access to Medicare and can include eligible family members in your application.

Important update: The Australian Government ceased accepting new applications for the Business Innovation and Investment (Provisional) visa (subclass 188) on 31 July 2024. This means the subclass 888 is now the primary focus for existing subclass 188 holders seeking permanent residency in Australia.

Subclass 888 Streams - Which One Applies to You?

The subclass 888 visa has multiple streams. Each stream matches the stream you held under your subclass 188.

Business Innovation Stream (888A)

This stream is for people who owned and managed a business in Australia while holding their subclass 188 visa.

Applicants must demonstrate ownership and active management of a business in Australia for at least two years. The business must have achieved an annual turnover of AUD $300,000 in at least one of the two years prior to applying. Applicants must also show a net business and personal asset value of at least AUD $600,000 within Australia.

For NSW applicants, the thresholds are higher. Minimum net assets of AUD $1.5 million (Sydney) for the 12 months before applying, along with business assets of at least AUD $600,000 and a minimum investment of AUD $500,000 (Sydney).

Investor Stream (888B)

This stream is for people who made a designated investment in a complying investment in a state or territory.

You must have resided in Australia as a subclass 188 holder under the Investor Stream for 2 years in the 4 years before lodging your 888 visa.

Entrepreneur Stream (888E)

This stream is for applicants who carried out entrepreneurial activities in Australia under their subclass 188E provisional visa.

A minimum of one of your Home Affairs success factors must have occurred in NSW. If you were nominated by another Australian state or territory for your subclass 188 visa, you must obtain a letter of release from your nominating state or territory.

Why Subclass 888 Applicants Choose CIA Lawyers

There are plenty of migration agents in Sydney. Here is why business owners and investors choose CIA Lawyers for their subclass 888 application.

Every person who works on your case holds formal legal qualifications. You are working with admitted lawyers. This matters when your application involves complex business structures, high-value assets, or compliance questions.

We look at your subclass 188 history, your business financials, your NSW nomination status, and your compliance record before we give you advice. We tell you what your case looks like honestly, including if there are issues we need to work through before lodging.

If your 888 application is refused, we do not pass you to another team. We handle your ART appeal in-house, using the same lawyers who prepared your original application.

You can speak to our team with no obligation. We explain your position and your options without any pressure.

How the Subclass 888 Application Process Works

The subclass 888 application is not a simple online form. It requires strong documentation, a valid state nomination, and a business plan that satisfies a case officer who may not have a business background.

Here is how CIA Lawyers works through this with you.

Step 1: Eligibility Check

We review your subclass 188 history, your business or investment activity, and your compliance with your provisional visa conditions. We identify any gaps before they become a problem.

Step 2: State Nomination

You need to be nominated by a state or territory government agency or Austrade on behalf of the Australian government. We help you prepare your NSW nomination application and gather the documents the NSW Government requires.

Step 3: Business Plan and Supporting Documents

You need to make a declaration using Form 1398 along with your application and provide a business plan outlining your plan to demonstrate an understanding of the Australian business and investment environment in which you are operating and how your activities will continue to provide economic benefits to Australia.

Step 4: Application Lodgement

We compile and lodge your complete application with the Department of Home Affairs, responding to any requests for further information along the way.

Step 5: Representation if Required

If your application is refused, we represent you at the Administrative Review Tribunal (ART) or advise you on alternative pathways.

One Important Thing Many Applicants Miss

Many subclass 188 holders make changes to their business without telling their nominating state or territory first. This is one of the most common reasons for 888 applications running into trouble.

It is common for subclass 188 visa holders to refine their business strategies after settling in Australia. If you are planning significant changes to your business, such as changing industries or restructuring the business, it is important to first update your business plan and submit it to your nominating State or Territory authority for review. Taking this step helps ensure your nomination remains valid and reduces the risk of visa refusal caused by nomination withdrawal.

We are familiar with court procedures, tribunal expectations and Department of Home Affairs processes, allowing us to prepare cases thoroughly and represent clients with confidence.

Strong preparation leads to strong outcomes. Our firm has successfully handled a wide range of visa applications, AAT appeals and judicial review matters. Each case is prepared thoroughly to maximise approval prospects and reduce unnecessary delays.

We Solve Complex Immigration Issues

Visa refusals, cancellations and character concerns require careful legal strategy. We analyse the reasons for refusal, identify the best pathway forward and represent you confidently in appeals and court proceedings when required.

What You Get When the Subclass 888 Visa Is Granted

Once your subclass 888 is approved, you and your included family members can:

  • Live and work in Australia permanently
  • Travel in and out of Australia freely for five years from the grant date
  • Access Medicare
  • Include eligible family members who also gain permanent residency
  • Apply for Australian citizenship after meeting the residency requirement

After five years, you will need a Resident Return Visa or another visa to return to Australia as a permanent resident.

Processing Times for the Subclass 888 Visa

Processing times vary depending on your stream and the completeness of your application.

The exact time taken to process an application under the subclass 888 visa depends on the stream applied for: Business Innovation stream takes around 10 to 11 months, while the Investor stream takes around 7 to 9 months.

Incomplete applications or requests for further information from the Department can extend these timelines significantly. Submitting a well-prepared application from the start reduces delay.

Frequently Asked Questions (FAQ)

Yes, in many cases, but you need to be careful. If your business changed significantly, such as a change in industry or ownership structure, your nominating state or territory needs to be aware. A nomination withdrawal will prevent your 888 application from being approved. CIA Lawyers reviews your situation before you lodge to identify and manage any risks.

You do not need to submit a new Expression of Interest or be invited to apply for this visa. Your eligibility is based on your existing subclass 188 visa and whether you have met its requirements.

A key feature of the subclass 888 visa framework is "role swapping", which allows a secondary visa holder under subclass 188 to become the primary applicant for the subclass 888 visa. This is particularly useful when the secondary applicant has taken the lead in managing the business or investment activities. This is a legal option but requires careful documentation. CIA Lawyers can advise you on how to structure this correctly.

If your application is refused, you generally have the right to appeal to the Administrative Review Tribunal (ART). Time limits apply, usually 21 days from receiving the refusal notice. CIA Lawyers handles ART appeals for business migration matters and can represent you through the process. Contact us as soon as you receive a refusal notice.

There is no legal requirement to use a lawyer, but subclass 888 applications involve detailed financial evidence, a formal business plan, state nomination requirements, and compliance checks across the full period of your provisional visa. Case officers sometimes request interviews, and applications with gaps or inconsistencies can be refused. Having a qualified lawyer prepare your case reduces the risk of refusal and helps you respond confidently if the Department asks questions.
