Bail Application Lawyers Sydney
When Freedom Is on the Line, Sydney Trusts CIA Lawyers
Experienced & Trusted Bail Lawyers in Sydney
If you or a loved one has been refused bail, our experienced Sydney criminal defence team is ready to act immediately. The NSW Bail Act allows you to apply for release at every court level, but the process moves incredibly fast and the stakes are high. Under section 74 of the Act, a second application to the same court is only allowed in very rare circumstances, meaning your first attempt must be perfectly prepared to avoid being kept in custody.
Our defence lawyers know exactly how Sydney courts assess risk and what prosecutors look for when opposing release. We work quickly to build a robust release plan with realistic conditions that satisfy the court, giving you the strongest possible chance of returning home to your family while your matter is resolved.

I’m truly grateful and happy to share that my subsequent entrant 500 visa has been granted today! My case was quite challenging — I had a very short marriage duration (only 3 months), and I had not even completed showing my graduation at the time of application. Because of these reasons, many agencies were not willing to take my case. But cia lawyers believed in my case and handled everything with great professionalism, honesty, and care. Their guidance, proper documentation, and constant support made this success possible. I highly recommend their service to anyone with a complex or genuine case. If your case is strong and truthful, the right legal support can truly make a difference. Thank you again for your dedication and hard work! I am greatful.Posted on Google![]()

I’m incredibly grateful to CIA Lawyers for helping me secure my Australian visa, especially at a time when the approval rate was extremely low. Even when the chances seemed slim, they stayed confident, guided me honestly, and handled my application with absolute precision. Their experience, attention to detail, and clear communication truly made the difference. I wouldn’t have gotten this result without them. Highly recommended.Posted on Google![]()

Bail Application Services We Provide Across Sydney
We handle the full range of bail matters across Sydney and New South Wales. Here is what we do.
Urgent Bail Applications in the Local Court
The Local Court is usually where a bail application is first heard after police have refused bail. You must be brought before the court as soon as practicable.
We prepare and run urgent Local Court bail applications, including same-day matters. We present a bail plan with realistic conditions, address the prosecution’s concerns, and put your best case to the magistrate.
Supreme Court Bail Applications
If bail has been refused by the Local Court, the Supreme Court may be the next step under section 66 of the Bail Act 2013. The Supreme Court requires all supporting material to be filed before a hearing date is allocated.
You typically only get one real opportunity at this level before the restrictions of section 74 apply. We prepare Supreme Court bail applications carefully, including supporting affidavits, character references, proposed accommodation arrangements, and any surety or security.
Bail Variation Applications
If you have been granted bail but the conditions are unworkable, you can apply to vary them under section 51 of the Bail Act 2013. Common reasons include conditions that prevent you from attending work, seeing your children, or living at a suitable address.
We identify which conditions are causing the problem, propose practical alternatives, and make the variation application on your behalf.
Show Cause Bail Applications
Some offences under section 16A of the Bail Act 2013 require the accused to first show cause why their detention is not justified before the court even considers whether to grant bail.
These include offences carrying life sentences, serious firearm offences, and some serious drug charges. Show cause is a significant legal hurdle. Preparation is everything, and our lawyers know how to build an argument that meets that threshold.
Bail for Serious and Indictable Offences
Serious criminal charges including murder, sexual assault, and armed robbery attract close scrutiny at bail hearings. The prosecution will raise unacceptable risk arguments and, where relevant, the show cause threshold.
We build structured bail applications for serious matters, addressing the four bail concerns under section 17 of the Bail Act: risk of failing to appear, risk of committing a serious offence, risk to the community, and risk of interfering with witnesses or evidence.
Bail for Domestic Violence Charges
Bail in domestic violence matters often involves contact and proximity conditions that affect where you can live and who you can see.
We advise on what is realistically achievable given the charges and the complainant’s position, and we prepare conditions that protect both the accused and any children from the practical disruption of overcautious bail conditions.
Bail for Young People and Children
The Local Court and Children’s Court have different bail considerations for accused persons under 18. The Bail Act 2013 applies to children but the court gives significant weight to family stability, school attendance, and rehabilitation.
We represent young accused persons and their families in bail applications and work with parents on appropriate supervision conditions.
Second Bail Applications
A second application to the same court is only permitted under section 74 of the Bail Act if there has been a change in circumstances, new material is available, or the accused was previously unrepresented.
We advise on whether the threshold for a fresh application is met and, if so, prepare and run that application effectively.
Representation in Bail Reviews and Appeals
If bail has been refused and a review or appeal is the appropriate next step, we handle that process. Reviews of bail decisions can be made by the Supreme Court or the Court of Criminal Appeal in appropriate cases.
We advise on the correct pathway and prepare the material required.

Yes. If police refuse bail, you must be brought before the Local Court as soon as practicable, and you can make a release application there. If the Local Court refuses bail, and the circumstances permit under section 74 of the Bail Act 2013, you may apply to the Supreme Court. Our lawyers advise on the correct pathway for your specific matter.
A show cause offence is one where the accused must first satisfy the court that their continued detention is not justified, before the court considers the unacceptable risk test. Show cause offences are listed in section 16A of the Bail Act 2013 and include offences carrying a maximum sentence of life imprisonment, serious firearm offences, and certain drug charges. If the show cause threshold is not met, bail must be refused regardless of the unacceptable risk assessment.
At the first appearance, the court receives the police facts sheet and the accused person's criminal history. The magistrate considers the bail concerns under section 17 of the Bail Act, hears from both sides, and decides whether to grant bail, refuse bail, or adjourn the matter. If you have a lawyer present who has prepared a bail plan with proposed conditions, you are in a much stronger position than if you appear without representation.
Yes. Under section 51 of the Bail Act 2013, an accused person can apply to vary bail conditions if circumstances have changed or the conditions are unworkable. The application must be filed at least three days before the next court date and notice served on the police prosecutor. Our lawyers handle variation applications and present practical alternative conditions to the court.
Potentially, yes. Under the Migration Act 1958, a person sentenced to 12 months or more imprisonment, including a suspended sentence, may fail the character test and face visa cancellation or refusal. Even being on remand or having certain charges on record can affect visa applications. If you or a family member is on a visa and facing criminal charges, it is important to tell your lawyer so immigration risk can be considered alongside the bail strategy.
