I’m truly grateful and happy to share that my subsequent entrant 500 visa has been granted today! My case was quite challenging — I had a very short marriage duration (only 3 months), and I had not even completed showing my graduation at the time of application. Because of these reasons, many agencies were not willing to take my case. But cia lawyers believed in my case and handled everything with great professionalism, honesty, and care. Their guidance, proper documentation, and constant support made this success possible. I highly recommend their service to anyone with a complex or genuine case. If your case is strong and truthful, the right legal support can truly make a difference. Thank you again for your dedication and hard work! I am greatful.Posted on Google![]()

I’m incredibly grateful to CIA Lawyers for helping me secure my Australian visa, especially at a time when the approval rate was extremely low. Even when the chances seemed slim, they stayed confident, guided me honestly, and handled my application with absolute precision. Their experience, attention to detail, and clear communication truly made the difference. I wouldn’t have gotten this result without them. Highly recommended.Posted on Google![]()

CIA Lawyers: Qualified Immigration Lawyers You Can Trust in Sydney
CIA Lawyers is a Sydney-based legal firm with dedicated expertise in Australian immigration law and family migration. Our team consists of qualified lawyers, not just registered migration agents. That difference matters when your child’s case becomes complicated.
Child visa applications are not simple. They involve custody documents, consent requirements, health checks, and strict eligibility rules. One missing document or wrong subclass can delay your child’s visa by months. We make sure that does not happen.
Our clients across Sydney, New South Wales, and Australia trust us because we handle their child’s case with the same care and urgency they would expect from a trusted family lawyer. We give you honest advice from day one, not just what you want to hear.
Our Child Visa Services in Sydney
Every child's situation is different. That is why CIA Lawyers handles the full range of child visa types available under Australian immigration law. We identify the right pathway for your family and manage the entire process from start to finish.
Subclass 101 and 802 - Child Visa for Permanent Residence
These are the two most common child visas in Australia. Both lead to permanent residency and give your child the right to live, study, and work in Australia without any time limit.
Subclass 101 is for children who are outside Australia when they apply. Subclass 802 is for children already inside Australia on a valid temporary visa.
Choosing the wrong subclass is one of the most common mistakes families make without legal advice. We confirm the right one for your child during your free consultation.
Once granted, your child can enrol in Australian schools, access Medicare, and eventually apply for Australian citizenship when eligible.
Subclass 102 - Adoption Visa
The Adoption Visa (Subclass 102) is for children being adopted by an Australian citizen, permanent resident, or eligible New Zealand citizen through a legally recognised intercountry adoption program.
The child must be under 18 at the time of application, at the time of adoption, and at the time of the visa decision. The adoption must be supported by a relevant state or territory adoption authority.
If the adoption took place under the Hague Adoption Convention, your child may qualify for Australian citizenship directly without needing a visa at all. We assess this during your consultation so no time is wasted.
Adoption visa cases involve a high level of legal and documentary complexity. CIA Lawyers guides you through every requirement carefully.
Subclass 117 and 837 - Orphan Relative Visa
The Orphan Relative Visa is for children under 18 whose parents have passed away, are permanently unable to care for them, or cannot be found.
Subclass 117 is for children applying from outside Australia. Subclass 837 is for children already in Australia.
To be eligible, the child must be sponsored by a close relative who is an Australian citizen, permanent resident, or eligible New Zealand citizen. This can include a sibling, grandparent, aunt, uncle, or step-relative.
These cases often involve sensitive circumstances and complex documentation. CIA Lawyers handles them with care, respect, and thorough legal preparation.
Subclass 445 - Dependent Child Visa (Temporary)
The Dependent Child Visa (Subclass 445) is a temporary visa for children whose parent holds a temporary partner visa and is waiting for the permanent partner visa to be decided.
This visa allows the child to live, work, and study in Australia during that waiting period. Once the parent’s permanent partner visa is granted, the child should apply for the permanent partner visa of the same class.
If your child was not included in your original partner visa application, this is the pathway to include them. CIA Lawyers manages the timing and lodgement carefully so your child is not left without lawful status in Australia.

Requirements for a Child Visa Application in Sydney
Meeting the eligibility requirements is only the first step. Building a well-documented, decision-ready application is what gets results.
Here is what the Department of Home Affairs generally requires for a child visa application:
The Child Must Be Eligible
The child must be the biological child, stepchild, or legally adopted child of the sponsoring parent. They must generally be under 18 years of age.
Children aged 18 to 25 can still apply if they are a full-time student and genuinely financially dependent on the sponsoring parent. Children over 18 with a disability that prevents them from working may also qualify regardless of age.
The child must also be single and not living in a de facto relationship at the time of application and at the time of the decision.
The Sponsoring Parent Must Qualify
The sponsor must be an Australian citizen, permanent resident, or eligible New Zealand citizen and must be at least 18 years old.
They must show they can provide adequate accommodation and financial support for the child for at least the first two years in Australia. There is no set income threshold, but the Department wants to see that the sponsor will not rely on government assistance to support the child.
Consent From Both Parents Is Usually Required
If the child is under 18, the Department of Home Affairs requires written consent from both parents or all people with parental responsibility before the visa can be granted.
This is done through Form 1229. If the other parent refuses to consent, is unreachable, or if custody arrangements are disputed, alternative legal steps are needed, such as a court order granting sole parental responsibility or permission to relocate the child.
CIA Lawyers advises on exactly what is needed in your situation and prepares all consent documentation properly.
Health and Character Requirements
All child visa applicants must meet Australian health requirements. This usually involves a medical examination through an approved panel physician.
Children aged 16 and over must also meet the character requirement, which includes obtaining a police clearance certificate from any country where they have lived for 12 months or more in the past 10 years.
A health concern or past issue does not automatically mean refusal. As qualified immigration lawyers, we can advise on your child's specific situation and how best to address it before lodgement.
Key Documents Required
A strong child visa application includes the following:Proof of relationship - birth certificate, adoption order, marriage certificate, or family status certificate confirming the child's connection to the sponsoring parent.
Identity documents - valid passport and two recent passport-sized photographs for the child and any dependants included in the application.
Sponsorship forms - Form 47CH (application by the child) and Form 40CH (sponsorship by the parent), submitted correctly and in full.
Consent documentation - Form 1229 completed by both parents, or a court order if consent cannot be obtained.
Financial evidence - bank statements, money transfers, or rent receipts showing the sponsor's ability to support the child.
Health examination results - completed through a Department-approved panel physician.
Police certificates - required for children aged 16 and over from every country of residence in the past 10 years.
Dependency evidence - for children aged 18 to 25, full-time student enrolment confirmation and proof of financial dependence on the parent.
Missing even one of these documents can push your child's application to the back of the processing queue or lead to a refusal. CIA Lawyers reviews every document before lodgement so nothing is left out.

How CIA Lawyers Handle Your Case
Step 1: Eligibility Assessment
Every family situation is different. We start by reviewing your child's age, location, relationship to the sponsor, and any custody or guardianship arrangements. We identify the correct visa subclass and confirm eligibility before any work begins. No assumptions, no generic advice.
Step 2: Sponsorship Preparation
The sponsoring parent must be an Australian citizen, permanent resident, or eligible New Zealand citizen and must be 18 or older. They must also meet health and character requirements and provide a written undertaking to support the child's accommodation and financial needs in Australia for at least the first two years.
We prepare all sponsorship forms and evidence to meet the Department's requirements from the start.
Step 3: Consent and Custody Documentation
Central to child visa applications is Form 1229, the document used to formally record parental or guardian consent before a child under 18 is granted an Australian visa.
Where consent is difficult or impossible to obtain because a parent is uncontactable, refuses to consent, or where custody arrangements are complex or disputed, alternative evidence or legal steps may be required, such as a court order granting permission for the child to travel.
We advise you on exactly what is needed in your specific situation and handle all consent and custody documentation carefully.
Step 4: Full Application Preparation and Lodgement
Child visa applications are paper-based, using Form 47CH and Form 40CH. From July 2025, applicants can import their paper application into ImmiAccount for online management after lodgement.
We prepare a complete, decision-ready application. This includes identity documents, birth certificates, proof of relationship, health examination referrals, police clearances, and any additional evidence required for your specific subclass.
Step 5: Ongoing Case Management and Post-Grant Advice
Once lodged, we monitor the application, respond to any requests from the Department of Home Affairs, and keep you updated at every stage. After grant, we advise on Medicare enrolment, schooling rights, and your child's pathway to Australian citizenship.

Visa refusals, cancellations and character concerns require careful legal strategy. We analyse the reasons for refusal, identify the best pathway forward and represent you confidently in appeals and court proceedings when required.Common Challenges in Child Visa Applications and How We Resolve Them
Custody Disputes and Consent Issues
This is the most common complication in child visa cases. If a non-migrating parent refuses consent and there is no court order granting sole parental responsibility, the Department of Home Affairs cannot grant the visa to the child. Migration law cannot override custody law.
We help families understand their legal position early, identify whether a court order is needed, and prepare the right documents to move the application forward.
Proving Financial Dependency for Older Children
Children between 18 and 25 must prove they are full-time students who are genuinely financially dependent on the sponsoring parent. The Department looks closely at this. We help you build a clear, documented case for dependency that satisfies the assessment criteria.
Step-Parent and Blended Family Situations
Step-parent relationships add another layer of legal complexity. Additional evidence is needed to show the step-parent relationship and parental responsibility. We know what the Department expects and prepare your documents accordingly.
Health and Character Requirements
All child visa applicants must meet Australian health requirements. Children aged 16 and over must also satisfy the character requirement. A past health concern or disclosed criminal matter does not automatically mean refusal, but it needs careful legal handling. As qualified immigration lawyers, we can advise properly on these issues before lodgement.
Incomplete or Incorrect Documentation
Missing consent forms cause 20% of delays in child visa applications. A missing birth certificate, outdated health examination, or inconsistent evidence can send your application to the back of the queue. We conduct a thorough review of every document before anything is submitted.
Visa Refusal and ART Review
If a child visa application is refused, you may have the right to seek a review at the Administrative Review Tribunal (ART). Strict time limits apply. As qualified lawyers, CIA Lawyers can represent your family at the ART and, where necessary, in Federal Court. We review the refusal decision, identify the grounds for challenge, and prepare the strongest possible case.
FAQ
The key difference is where your child is located. The Subclass 802 requires the applicant to be onshore at the time the application is lodged and when a decision has been made. Conversely, the Subclass 101 requires the applicant to be offshore at the time the application is lodged and when a decision is made. Both are permanent visas once granted. We confirm which subclass applies to your child during your free consultation.
Yes, in some cases. Children between 18 and 25 years old may be eligible if they are a full-time student and financially dependent on the sponsoring parent. The child must also be single and not in a de facto relationship. Evidence of genuine financial dependency and full-time enrolment must be provided at both the time of application and when the decision is made.
This is one of the most common and stressful situations families face. Where a parent refuses consent and there is no court order granting sole parental responsibility, alternative legal steps are required, such as a court order granting permission for the child to travel or relocate. We can advise you on the legal options available and help you build the right case to move the application forward.
Processing currently takes between 18 and 34 months. Around 75% of applications are finalised within 21 months. Incomplete documentation, missing consent forms, or health concerns can push your case toward the longer end of that range. A well-prepared application from the start gives your child the best chance of a faster outcome.
A refusal is not necessarily the end. Depending on the grounds of refusal and the subclass, you may have the right to seek a review at the Administrative Review Tribunal (ART). Time limits apply and they are strict, so you need to act quickly. As qualified immigration lawyers, CIA Lawyers can advise whether the refusal can be challenged and represent your family through the full review process, including Federal Court if required.
