I’m truly grateful and happy to share that my subsequent entrant 500 visa has been granted today! My case was quite challenging — I had a very short marriage duration (only 3 months), and I had not even completed showing my graduation at the time of application. Because of these reasons, many agencies were not willing to take my case. But cia lawyers believed in my case and handled everything with great professionalism, honesty, and care. Their guidance, proper documentation, and constant support made this success possible. I highly recommend their service to anyone with a complex or genuine case. If your case is strong and truthful, the right legal support can truly make a difference. Thank you again for your dedication and hard work! I am greatful.

I’m incredibly grateful to CIA Lawyers for helping me secure my Australian visa, especially at a time when the approval rate was extremely low. Even when the chances seemed slim, they stayed confident, guided me honestly, and handled my application with absolute precision. Their experience, attention to detail, and clear communication truly made the difference. I wouldn’t have gotten this result without them. Highly recommended.

Family Law Services for Burradoo and the Southern Highlands

We handle all family law matters for individuals and families across Burradoo and the surrounding region.

Rural Property Disputes

Property settlement in Burradoo and the Southern Highlands frequently involves acreage, rural lifestyle properties, equestrian holdings, farming businesses and long-held family land. The Federal Circuit and Family Court follows a four-step process under section 79 of the Family Law Act: identifying all assets and liabilities, assessing each party’s contributions, considering future needs, and arriving at a just and equitable outcome.

In this region, accurate rural property valuation, identifying interests in farming operations and separating personal assets from trust structures are often the central issues. We work through this carefully so you know your realistic position before any negotiation starts.

Parenting Plans After Separation

Decisions about where children live, time spent with each parent and who makes major long-term decisions do not always require court intervention. Most families in the Southern Highlands reach workable arrangements through direct negotiation or family dispute resolution, which is a legal requirement before filing in court for most parenting matters.

Where court proceedings are necessary, every order is made with the child’s best interests as the primary consideration under section 60CC of the Family Law Act.

Formalising Agreements with Consent Orders

Reaching an agreement privately is a positive outcome, but without court approval it carries no legal weight. Consent orders give your parenting or property agreement the same force as a court order, making it enforceable if either party later fails to comply.

For financial matters, a Binding Financial Agreement can provide certainty without court involvement, provided both parties receive independent legal advice. We prepare both, review any agreement before you sign and make sure nothing is overlooked that could become a dispute later.

De Facto Separation and Your Legal Rights

De facto couples who separated after 1 March 2009 have the same legal rights as married couples under the Family Law Act for both property and parenting matters. The same time limits apply: two years from the date of separation to commence property proceedings.

In the Southern Highlands, where de facto couples may have jointly built or acquired rural properties, livestock operations or equestrian businesses during the relationship, those contributions are fully recognised under the law.

Family law - Divorce - CIA Lawyers (700)

Divorce Applications

To apply for divorce in Australia, couples must have lived separately for at least 12 months and satisfy the Federal Circuit and Family Court that the marriage has broken down irreparably. Divorce ends the legal marriage only. Property and parenting matters are handled through separate proceedings with their own strict deadlines under the Family Law Act 1975 (Cth).

Married couples have 12 months from the divorce order to commence property proceedings; de facto couples have two years from the date of separation. We assist with the application itself and advise on the critical steps that need to happen alongside it.

Parenting Orders and Arrangements

When parents separate, arrangements for children can often be reached through negotiation or family dispute resolution, which is required by law before most parenting court applications can be filed, except in urgent or safety-related circumstances.

Where court proceedings are necessary, the court’s primary consideration is always the best interests of the child under section 60CC of the Family Law Act. In regional areas like Berrima, parenting matters sometimes involve particular considerations around school catchments, access to health services, one parent relocating closer to Sydney for work, or the practical difficulty of shared care when distances between households are significant.

Spousal Maintenance

Spousal maintenance applies when one party to a marriage or de facto relationship cannot adequately support themselves after separation, and the other party has the financial capacity to help. It is assessed separately from child support and property settlement, and has its own application process and time limits.

We assess whether you have a claim, what amount is realistic, and how to pursue or respond to a spousal maintenance application efficiently.

Child Support

Services Australia calculates child support using a formula based on each parent’s taxable income, the care arrangement and the number of children. This works well in many situations, but rural income, seasonal earnings, farming profits and trust distributions can make the standard assessment inaccurate.

Where the formula does not reflect the true financial picture, parents can apply to depart from it or formalise a private agreement as a limited child support agreement.

Domestic Violence Orders and Family Law Proceedings

Apprehended Domestic Violence Orders can arise during or alongside family law proceedings, and a final ADVO carries significant consequences for parenting arrangements, employment and day-to-day life.

We represent clients in the NSW Local Court for ADVO applications, whether you need protection or are responding to an order taken out against you. Both situations require prompt legal advice. Acting early gives you the best chance of managing the outcome, particularly where children and property proceedings are running at the same time.

Why Burradoo Families Come to CIA Lawyers

People in the Southern Highlands choose CIA Lawyers for reasons that go beyond location.

Our team of dual-qualified solicitors and barristers handles your matter seamlessly from your initial consultation all the way to the courtroom.

Southern Highlands separations often involve rural property, farming interests, equestrian businesses and family trust structures. We understand how these assets are assessed and divided under the Family Law Act, and we know what questions to ask to make sure nothing of value is left out of the asset pool.

Getting to Sydney for every meeting is not always practical when you are in the Southern Highlands. We offer phone and video consultations as a standard option, and full written advice so you are never left guessing after a meeting.

Property settlement and parenting matters are heavily influenced by what is documented early in the process. We identify what needs to be gathered, secure it properly, and make sure your position is clearly supported before any negotiation begins.

How We Work With You

Step 1 - Personalised Consultation

Book a time with our Sydney family law team. You tell us what is happening. We ask the right questions and explain your legal position honestly.

Step 2 - Clear Plan

We give you a clear picture of your options, the likely process, and the costs involved. No pressure. You decide how to proceed.

Step 3 - We Handle It

Once you are ready to move forward, we manage everything. We communicate with the other side, prepare all documents, and keep you updated throughout.

What Sets us Apart

Seamless Courtroom Representation

Most firms prepare your paperwork but charge you thousands extra to hire an outside barrister for court. We do things differently. Our team includes both in-house solicitors and barristers, meaning the exact same lawyers who know your story are the ones standing up for you before the judge. This all-in-one approach keeps your strategy seamless and saves you from paying double-handling legal fees.

Strategic Case Preparation

Great family law outcomes are built long before any negotiation or court hearing begins. We collect and organize your financial records, asset documents, and parenting timelines right from the start. This thorough approach gives you clear leverage and ensures you enter discussions from a position of maximum strength.

Straightforward Family Law Strategy

We won’t give you false hope just to keep your file open and run up your bill. You get the honest, unfiltered truth about your chances, costs, and options from day one. If a settlement saves you years of stress and thousands in legal fees, we will tell you to take it. Because our goal is to get you out of the legal system, not trap you in it.

Frequently Asked Questions (FAQ)

Costs vary depending on whether your matter settles by consent or proceeds to court. A straightforward property consent order agreed between parties costs considerably less than a contested hearing. At your first consultation, we give you a realistic cost range based on your specific circumstances.

Most family law matters in NSW resolve without a final hearing, through negotiation, mediation or consent orders. Court becomes necessary when one party refuses to engage, when there is an urgent risk to a child's safety, or when the complexity of the assets makes agreement impossible. We advise you on the most practical pathway for your situation rather than defaulting to litigation.

Yes. An initial consultation gives you independent legal advice on your rights and options with no obligation to continue. We recommend getting early advice even if you are unsure whether you need a lawyer, because decisions made in the first weeks of a separation can limit your options later.

A parenting plan is a written agreement between parents that is not legally enforceable. Parenting orders, made by consent or by the court after a hearing, are legally binding and can be enforced if breached. We recommend formalising parenting arrangements as consent orders rather than a parenting plan to give both parties certainty.

Separation and family law matters do not get easier by waiting.

The sooner you get proper legal advice, the better your position will be.

CIA Lawyers advises Burradoo families on every stage of family law, from the first week of separation to final court orders. We give you honest advice, handle the legal process and make sure your family's future is protected.
