Driver Licence Appeals
Losing your licence can seriously affect your work, family, and day-to-day life. If you’ve been suspended or cancelled due to speeding, demerit points, or a medical issue, you may be able to appeal — but only in certain cases.
Whether you’re dealing with a traffic suspension, medical cancellation, or police-issued ban, we have the legal support you need to protect your rights.
When You Can Appeal
You can appeal some licence suspensions at the Local Court:
- Demerit Points: Learner or provisional drivers can appeal. Unrestricted drivers cannot, but may get a Good Behaviour Licence.
- Speeding: Suspensions for going 30km/h or 45km/h over the limit can be appealed.
- Police Suspensions: Immediate bans for serious offences like drink driving or street racing are harder to appeal and need exceptional hardship proof.
- Medical Cancelling: You can appeal if your licence is cancelled due to health, with medical proof.
- Unpaid Fines: No appeal. Pay fines or arrange payments to lift suspension.
How the Appeal Process Works
You have 28 days from the suspension or cancellation notice to lodge your appeal with the Local Court and pay the filing fee. You’ll get a hearing date soon after.
Before court, gather any helpful documents like a letter explaining your case, character references, employer letters, medical reports, or a Traffic Offender Intervention Program certificate.
At the hearing, the magistrate reviews the evidence from both sides. If it’s a police suspension, you must prove exceptional circumstances. For Transport NSW suspensions, you need to show it’s just in the circumstances to change the decision.
The court can allow, dismiss, vary, or make any order it sees fit. This decision is final—there’s no further appeal.

FAQs
Q: Can I appeal a demerit point suspension if I have a full licence?
A: No. Only learner and provisional drivers can appeal demerit point suspensions. Full licence holders must apply for a Good Behaviour Licence instead.
Q: What are “exceptional circumstances” in a police suspension appeal?
A: They could include things like serious medical needs, urgent family obligations, or losing a job that depends on your licence. The bar is high, and strong evidence is needed.
Q: Will a lawyer really make a difference in my appeal?
A: Yes. A good lawyer can prepare a stronger case, present persuasive submissions in court, and help you avoid common mistakes that could sink your appeal.
