I’m truly grateful and happy to share that my subsequent entrant 500 visa has been granted today! My case was quite challenging — I had a very short marriage duration (only 3 months), and I had not even completed showing my graduation at the time of application. Because of these reasons, many agencies were not willing to take my case. But cia lawyers believed in my case and handled everything with great professionalism, honesty, and care. Their guidance, proper documentation, and constant support made this success possible. I highly recommend their service to anyone with a complex or genuine case. If your case is strong and truthful, the right legal support can truly make a difference. Thank you again for your dedication and hard work! I am greatful.Posted on Google![]()

I’m incredibly grateful to CIA Lawyers for helping me secure my Australian visa, especially at a time when the approval rate was extremely low. Even when the chances seemed slim, they stayed confident, guided me honestly, and handled my application with absolute precision. Their experience, attention to detail, and clear communication truly made the difference. I wouldn’t have gotten this result without them. Highly recommended.Posted on Google![]()

Visa Appeal Services We Handle in Sydney
Administrative Review Tribunal (ART) Appeals
The Administrative Review Tribunal replaced the old Administrative Appeals Tribunal (AAT) on 14 October 2024. It is the main body that reviews visa refusals and cancellations made by the Department of Home Affairs.
A merits review at the ART is different from a court hearing. The Tribunal looks at your case completely fresh. It can consider new evidence that was never part of your original application. It decides what the correct outcome should be based on all the facts.
We prepare your entire ART application, gather fresh evidence, write legal submissions, and represent you at the hearing. You do not need to face the Tribunal alone.
Visa Cancellation Reviews
A visa cancellation is different from a refusal. Your visa was granted, but the Department has now moved to cancel it. Common reasons include character concerns, a failure to comply with visa conditions, or information the Department received after your visa was granted.
Cancellation carries serious consequences. You may be detained while the process continues. You may face removal from Australia.
We act quickly in cancellation matters. We advise you on your rights, respond to any notice of intent to cancel, and if the cancellation decision is made, we lodge your ART review immediately.
Character Cancellations and Section 501 Matters
Section 501 of the Migration Act gives the Department and the Minister the power to refuse or cancel a visa on character grounds. This applies if you have a substantial criminal record, associations with criminal groups, or other serious character concerns.
These are among the most complex and high-stakes cases in Australian immigration law. The consequences of losing are severe, including removal and a ban on returning to Australia.
We provide full legal representation in Section 501 matters. We review the Department's decision, prepare detailed legal submissions, and represent you at the ART or in court if needed.
Employer Sponsorship and Nomination Refusals
If your employer's sponsorship or nomination was refused, you cannot proceed with your visa application. In many cases, the sponsor or nominator has the right to appeal the refusal at the ART.
We advise sponsors and applicants on whether the refusal is reviewable and handle the appeal process from start to finish.
Federal Court Judicial Review
If the ART dismisses your appeal, you may have further options. A judicial review in the Federal Circuit and Family Court of Australia or the Federal Court examines whether the Tribunal made a legal error in how it handled your case.
This is not a fresh look at the facts. It is a legal challenge based on errors of law, procedural unfairness, or the Tribunal exceeding its powers.
As qualified lawyers, we can represent you fully in court. This is something a registered migration agent is not able to do.
Ministerial Intervention Requests
In rare cases, the Minister for Immigration has a discretionary power to step in and make a more favourable decision. This is available after the ART process is exhausted.
Ministerial intervention is not a formal appeal. It is not guaranteed. But in some cases, it is the right next step.
We advise you on whether your circumstances meet the relevant criteria and prepare a compelling submission if that pathway is open to you.

Why Sydney Visa Applicants Choose CIA Lawyers for Appeals
This matters for appeals. We can provide full legal advice, draft legal submissions, appear at tribunal hearings, and take your case to the Federal Court if needed. A migration agent cannot do any of that.
We read the refusal decision in full. We identify every specific reason the Department refused your visa. We then build your appeal around addressing those exact reasons with new, stronger evidence.
If your appeal has weak prospects, we tell you that upfront. We also advise you on whether a fresh application, a different visa pathway, or another strategy might work better than an appeal.
Visa appeal deadlines are short. We are ready to act quickly the moment you contact us, so you do not lose your review rights because of a delay.
You can speak with our team before committing to anything. We will review your refusal letter, confirm your deadline, and give you a clear assessment of your options at no cost.
Cases We Handle
First-time refusals where the original application lacked evidence or made errors
Refusals based on character concerns or criminal history requiring detailed legal submissions
Refusals where the Department misunderstood or incorrectly assessed the evidence
Visa cancellations including emergency situations where a person is at risk of detention
Appeals where a previous ART hearing was poorly prepared or legally flawed
Cases where the applicant is close to the Section 48 bar and needs advice on whether an appeal or offshore application is the better path
Federal Court judicial review after an unsuccessful ART appeal
Clients who applied without a lawyer and received a refusal they did not expect
What Sets us Apart
Proven Track Record of Success
Strong preparation leads to strong outcomes. Our firm has successfully handled a wide range of visa applications, AAT appeals and judicial review matters. Each case is prepared thoroughly to maximise approval prospects and reduce unnecessary delays. We Solve Complex Immigration Issues
Visa refusals, cancellations and character concerns require careful legal strategy. We analyse the reasons for refusal, identify the best pathway forward and represent you confidently in appeals and court proceedings when required.FAQ
It depends. If you are onshore, applying again for the same visa is often blocked by the Section 48 bar under the Migration Act. This bar prevents you from lodging most new visa applications inside Australia after a refusal. In many cases, your only path forward is an ART appeal. We will check whether the bar applies to your situation and advise you on the best strategy before you make any moves.
You typically have 21 days from receiving your refusal notice. Some visa types allow 28 days. Your letter will state the exact deadline. Do not wait. Call us as soon as you receive the refusal. We can confirm your deadline and start preparing your appeal immediately.
A merits review at the ART is a completely fresh look at your case. The Tribunal considers all the facts and evidence, including new documents you provide. It decides what the right outcome should be. A judicial review in the Federal Court only looks at whether the Tribunal made a legal error. The court does not re-examine the facts. Merits review is available first, and it is usually the stronger option for most applicants.
Yes. Visa cancellations are reviewable at the ART in most cases. The process is similar to a refusal appeal, but cancellation matters often involve tighter timelines and higher stakes, especially if you are being detained or face immediate removal. Contact us urgently if your visa has been cancelled. We handle cancellation matters as a priority.
A registered migration agent can prepare your ART appeal documentation and advise on migration matters. An immigration lawyer can do all of that, and also provide full legal advice, draft legal submissions, argue matters of law, appear at hearings as your legal representative, and take your case to the Federal Circuit Court or Federal Court if the ART appeal fails. For straightforward appeals, both can help. For complex cases involving character concerns, legal errors, court proceedings, or Section 501 matters, you need a qualified lawyer.
